Book Description: This book shows six different realities of same-sex families. They range from full recognition of same-sex marriage to full invisibility of gay and lesbian individuals and their families. The broad spectrum of experiences presented in this book share some commonalities: in all of them legal scholars and civil society are moving legal boundaries or thinking of spaces within rigid legal systems for same-sex families to function. In all of them there have been legal claims to recognize the existence of same-sex families. The difference between them lies in the response of courts. Regardless of the type of legal system, when courts have viewed claims of same-sex couples and their families as problems of individual rights, they have responded with a constitutional narrative protecting same-sex couples and their families. When courts respond to these claims with rigid concepts of what a family is and what marriage is as if legal concepts where unmodifiable, same-sex couples have remained outside the protection of the law. Until forty years ago marriage was the only union considered legitimate to form a family. Today more than 30 countries have granted rights to same sex couples, including several that have opened up marriage to couples of the same sex. Every day there is a new bill being discussed or a new claim being brought to courts seeking formal recognition of same sex couples. Not all countries are open to changing their legal structures to accommodate same-sex couples, but even those with no visible changes are witnessing new voices in their communities challenging the status quo and envisioning more flexible legal systems.

Book Description: In this book, layperson Kevin Mahoney argues that Christian churches should embrace same sex marriage. Although many conservative Christians (including St. Paul) reject homosexuality due to the laws of Moses, Kevin points out that very few (if any) of these three-thousand-year-old Mosaic laws are upheld today, and that homophobia is contrary to the spirit and manner of our Lord Jesus Christ. Kevin highlights the many passages in the Bible that support the view that Jesus reformed the covenant that God gave Moses, and that this paves the way for Christianity’s adoption of LGBT rights. Jesus himself never condemned homosexuality; however, He did illuminate the hypocrisy of the Pharisees. Kevin argues that the Pharisees are very much alive today in the form of conservative Christians that proscribe homosexuality. Since most of the laws against homosexuality around the world have a religious basis, then this book's demolition of the conservative Christian argument against homosexuality will also be instructive for non-religious LGBT rights campaigners. Using the Parable of the Prodigal Son as an analogy, Kevin outlines how liberal and conservative Christians can finally agree on the divisive issue of same sex marriage.

Book Description: This book brings together historical, social science, and legal considerations to examine the role that procreative and child welfare claims have played in policy and legal debates involving same-sex marriage. In doing so, the book addresses and refutes the claim that same-sex marriage bans are needed in order to promote responsible procreation and child welfare objectives. It places the current marriage debates in a broader historical context by exploring how the procreative and child welfare claims that are today used to try to deny same-sex couples the opportunity to marry are similar to earlier arguments used to defend interracial marriage bans, laws prohibiting disabled individuals from marrying, and the differential treatment of children born out of wedlock. The book also examines the social science literature on the relationship between family structure and child well-being and assesses its relevance to the policy and legal debates over same-sex marriage. In particular, the book explores the relevance of the social science studies on the children of lesbians and gay men to the constitutional question of whether same-sex couples have a right to marry. The book looks closely at the gay marriage cases that recently reached the Supreme Court and explains why the constitutionality of same-sex marriage bans cannot be defended on the basis that maintaining marriage as an exclusively heterosexual institution helps to promote the best interests of children.
